In April, the legislature passed legislation (HB 2014) to encourage the construction of data centers in West Virginia, despite the devastating community impact of these facilities. Worse, HB 2014 preempts local control, giving most review powers to the Secretary of Commerce. With no checks and balances, no required public comment or notice, and no independent review from engineers or other environmental experts, this legislation gives the Secretary of Commerce broad discretion. Communities that didn’t choose to build the data centers will shoulder the burden. The West Virginia Division of Economic Development has proposed rules to govern the program, and we need your help improving them. Tell the Secretary of Commerce that they must amend the rules to require more disclosure from big data centers and create opportunities for public input on applications. Please hurry!
