NOTICE OF PUBLIC HEARING AND PUBLIC COMMENT PERIOD

The West Virginia Department of Environmental Protection, Division of Air Quality is soliciting comment on, and will hold two public hearings on: the Proposed Ozone Early Action Plan (EAP) to Attain and Maintain the 8-hour Ozone National Ambient Air Quality Standards for the West Virginia Eastern Panhandle Region, Berkeley and Jefferson Counties Pursuant to the Ozone Early Action Compact (EAC).

Once finalized, this ozone early action plan will be submitted to the U.S. Environmental Protection Agency (EPA) for approval and incorporation as a revision to the State Implementation Plan (SIP). The public hearings will be held at the following times and locations:

Written and oral comments will be accepted until the close of the hearing on December 22, 2004 and will be made a part of the formal record. The public may submit written comments by mail, facsimile (304) 926-0479 or other delivery to the Division of Air Quality through December 22, 2004, for inclusion in the rule-making record at the following address:

Comments submitted by mail must be postmarked by December 22, 2004. On or before November 19, 2004, copies of the proposed ozone early action plan will be available for public review during normal business hours at the DEP Charleston office; local libraries listed below; and may be viewed electronically on the Division of Air Quality website under the public notice and comment section:
