Earlier this month, West Virginia Senator Joe Manchin introduced The Building American Energy Security Act of 2023. This legislation changes how federal agencies handle energy projects and takes the dangerous and unprecedented step of requiring agencies to issue all permits within 30 days for the Mountain Valley Pipeline without further public involvement and without judicial review. More

West Virginia is once again at the center of debate in Congress. Yesterday, legislation was released that changes how energy projects are handled by federal agencies and requires the immediate approval of construction of the Mountain Valley Pipeline with no judicial review as part of a spending bill that Congress must pass by September 30, or the federal government will shut down. More

This permit is required by Section 401 of the Clean Water Act to ensure that a project can meet water quality standards. The WVDEP has the authority to approve, approve with special conditions, or deny MVP’s application. More

The Mountain Valley Pipeline (MVP), a 303-mile project cutting through Wetzel, Harrison, Doddridge, Lewis, Braxton, Webster, Nicholas, Greenbrier, Summers, and Monroe Counties, was recently fined approximately $303,000 by WVDEP. The proposed agreement for the fine is now open for public comment. Comments are due March 13. More

Construction Stopped on Mountain Valley Pipeline (at least temporarily)
The United States Court of Appeals for the Fourth Circuit has granted a stay of the actions of the United States Army Corps of Engineers in its approvals of stream and wetland crossings by the Mountain Valley Pipeline. This means that construction on stream crossings has to stop until the appeal is decided. More

More

The biggest energy project you’ve never heard of commonly goes by the acronym ASTH—the Appalachian Storage and Trading Hub. This massive petrochemical hub in West Virginia and Pennsylvania would be the largest infrastructure in the region’s history, consisting of hundreds of miles of pipelines, fracked gas processing facilities, and underground storage of petrochemicals and fracked gas liquids.
